These Terms & Conditions ("Terms") constitute a legally binding agreement between you ("Customer", "User", or "you") and Smart Vision TechLabs ("Operator", "we", "us", or "our"), governing your access to and use of MyGrowthEngine ("the Service" or "Platform"), available at mygrowthengine.net and its associated subdomains and APIs.

MyGrowthEngine is an autonomous AI growth operating system and digital software product developed, owned, and operated by Smart Vision TechLabs, located at 241/15 Nainagarh, Jhansi, Uttar Pradesh 284003, India. MyGrowthEngine is not a separate incorporated legal entity; all contractual obligations, billing operations, commercial licenses, and intellectual property rights reside with Smart Vision TechLabs.

By accessing or using MyGrowthEngine, creating an account, running website audits, activating promotional trials, or subscribing to paid software plans, you confirm that you have read, understood, and agreed to be bound by these Terms. If you do not agree, you must immediately cease all access and use of the Platform.

To access authenticated features, you must register an account and establish an Organization Workspace. You represent and warrant that:

• You are at least 18 years of age and possess the legal authority to enter into binding agreements.
• All registration credentials, company names, and billing details provided are accurate and current.
• If you register on behalf of a company or agency, you have explicit authority to bind that entity to these Terms.
• You are solely responsible for maintaining the confidentiality of your credentials and session tokens.

Organizations operate as isolated multi-tenant units. The organization administrator is accountable for all activity, team member invites, API consumption, and billing charges incurred within their workspace.

MyGrowthEngine provides automated website crawling tools to evaluate search engine optimization (SEO), SSL certificate status, mobile performance, structured metadata, and growth velocity metrics.

By submitting any domain or URL to the scanner, you explicitly warrant that:

• You own the submitted domain, have operational authority over it, or are analyzing publicly available web resources for legitimate business evaluation.
• You will not submit domains containing illegal material, malware, or credential phishing forms.
• You will not spam scan endpoints or execute automated denial-of-service requests against the crawling engine.

Scanner scores, recommendations, and execution tasks are diagnostic approximations and educational guides. Smart Vision TechLabs does not guarantee search ranking increases, traffic increases, or revenue outcomes based solely on scanner guidance.

Eligible agencies, growth teams, and enterprise evaluators may be granted access to our promotional 14-Day Agency Pilot.

• Zero Payment Required: The Agency Pilot is completely free of charge. No credit card or payment authorization is required to activate the Pilot.
• No Automatic Billing: The Pilot does not automatically convert into a paid subscription upon completion of the 14-day promotional window.
• Pilot Entitlements: The Agency Pilot provides expanded project capacity, team member seats, and proposal generation quotas solely for evaluation during the 14-day duration.
• Expiration: Following the 14-day duration, the workspace reverts to the Free tier unless the organization voluntarily activates a paid subscription plan.

MyGrowthEngine offers tiered monthly software subscriptions designed for businesses and agencies:

Paid Plan 14-Day Trial: Selecting a paid plan initiates a 14-day trial. A valid payment method (credit/debit card or supported instrument via Razorpay) is required to authenticate your subscription mandate. Billing begins automatically on Day 15 for the canonical plan amount unless cancelled prior to trial expiration.

Authoritative Organization Currency: Your billing currency is governed strictly by your organization's authoritative currency setting (USD or INR). We enforce strict currency integrity:

• USD organizations are billed canonical USD amounts ($29, $99, $249, $499/mo).
• INR organizations are billed canonical INR amounts (₹2,499, ₹7,999, ₹19,999, ₹39,999/mo).
• No Silent FX Conversion: We do not perform automatic foreign exchange markups, nor fallback currency substitutions between USD and INR.
• All recurring subscription payments are processed securely through our authorized payment partner, Razorpay.
• Statutory taxes (such as Goods and Services Tax / GST in India) are applied as mandated by applicable fiscal laws.

MyGrowthEngine integrates artificial intelligence capabilities (powered by Google Gemini API infrastructure) for growth plan generation, copy ideation, automated executive proposals, and decision recommendations.

• Credit Quotas: Paid plans and the Agency Pilot include monthly AI credit allowances. If your allowance is depleted, generation requests are held until the next billing rollover or credit top-up.
• Nature of AI Outputs: Outputs generated by AI tools are assistive drafts. You remain solely responsible for reviewing, verifying, and approving any copy, legal disclaimers, or strategic advice prior to publishing or presenting to clients.
• No Model Training on Customer Data: Customer business prompts and proprietary data are transmitted via encrypted API channels and are not used to train public foundation models.

Customer Ownership: You retain all ownership, rights, and title to your business profiles, uploaded brand logos, marketing collateral, customer data, and generated final proposals.

Operator Ownership: Smart Vision TechLabs retains all rights, title, and interest in and to MyGrowthEngine, including source code, database architecture, algorithms, user interfaces, design systems, logos, documentation, and the MyGrowthEngine brand.

You are granted a revocable, non-exclusive, non-transferable commercial SaaS license to access and use the Platform during your active subscription or trial. You may not reverse engineer, decompile, copy, or redistribute platform components.

You agree not to use the Platform to:

• Violate any local, national, or international statute, law, or regulation.
• Crawl, probe, or scan third-party websites without legitimate authorization or ownership.
• Transmit malicious code, viruses, trojans, or automated scraping scripts.
• Attempt unauthorized access to our production server infrastructure, databases, or fellow tenant workspaces.
• Resell or sublicense access to MyGrowthEngine without an authorized Agency White-Label license.

The Platform integrates with third-party providers for critical functions:

• Razorpay: Payment gateway and subscription mandate management.
• Google Cloud & OAuth: User authentication and Gemini AI inference.
• Resend: Transactional email delivery and notification alerts.

Your interactions with third-party providers are governed by their respective service terms. Smart Vision TechLabs is not liable for temporary outages, latency, or policy changes introduced by external service providers.

User Cancellation: You may cancel your subscription at any time directly through your dashboard at /dashboard/billing. Cancellation takes effect at the end of the active paid billing cycle; no further charges will be made.

Operator Suspension: Smart Vision TechLabs reserves the right to suspend or terminate accounts that violate our Acceptable Use Policy, engage in fraudulent payment activity, or present security risks to platform operations.

MYGROWTHENGINE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. SMART VISION TECHLABS DISCLAIMS ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL SMART VISION TECHLABS, ITS FOUNDERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING LOSS OF PROFITS, DATA, BUSINESS OPPORTUNITY, OR GOODWILL). OUR TOTAL AGGREGATE LIABILITY ARISING FROM OR RELATING TO THESE TERMS SHALL NOT EXCEED THE TOTAL AMOUNT ACTUALLY PAID BY YOU TO US DURING THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

These Terms and any disputes arising from or relating to your use of MyGrowthEngine shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles.

Any legal proceedings or arbitration relating to these Terms shall be instituted exclusively in the competent courts located in Jhansi, Uttar Pradesh, India, and both parties consent to personal jurisdiction therein.
